Non Payment of Contributions

 

South Gloucestershire Council would like to remind all care homes of the process if service user contributions, third party top up payments and/or monies provided for an individual’s expenses are not paid by the individual, their family/financial agent or holder of POA for property and Finance.

Care Homes must follow clause 6.1.4 and then contact the Council as soon as they become aware that payments have not been made or within 90 days in line with clause 11.40.2.

 6.1.4

The Council appoints the Provider as its agent for the purpose of the collection of any Service User or Third-Party Contribution payable. For those Service Users whose services are not fully funded by the NHS, not less frequently than once per month the Provider shall send a written request for payment of : 

  • The Service User Contribution to the individual or their representative; and (if applicable). 

  • The Third-Party Contribution to the relevant third-party requiring payment by the relevant paying party; and collect such payments from any Service User or Third-Party Contribution (if any) from the person responsible for paying it unless it has been expressly agreed that it will be paid to the Council as described in Condition 16.4 -16.9.

 11.40.2

Within 10 working days in writing unless Condition 11.40 or Condition 11.41 also applies in which case those Conditions will prevail,  

  • If the Service User or Third Party has failed to make a payment of the Service User or Third-Party Contribution to the Provider within 90 days of when it should have been paid.
